court of nisi prius (1)〈英〉独任巡回初审法庭 「nisi prius」意指「除非在这之前」〔unless before〕，原是在出庭令〔venire facias〕中所用的特殊用语，按通常做法，该令状指令郡长〔sheriff〕应于某日将被选定的陪审员〔jurors〕带至位于威斯敏斯特的法院出庭，除非在该日以前〔unless before that day；nisi prius〕该案件已为到过该郡的巡回法官〔justice of assize〕审理。依据1285年《初审法令》〔Statute of Nisi Prius〕亦即1285年《威斯敏斯特法Ⅱ》〔Statute of Westminster the Second〕规定，在这种除外情况下，郡长应将陪审团带至巡回法官前参审。这种审判方式就得名为巡回初审〔trial at nisi prius〕，实质即是「trial of assize」。以前普通法诉讼形式采用合议庭审判〔trial at bar〕，即由几名法官组成合议庭〔full court〕审判，而巡回法官审判采取独任制，故将组成的法庭称为独任巡回初审法庭〔court of nisi prius〕。在独任巡回初审法庭进行的审判因此区别于其它3种审判形式：合议庭审判、刑事审判和低级法院审判〔trial in an inferior court〕。独任巡回初审法庭最初只在巡回陪审〔assize〕的民事诉讼和一些土地诉讼中使用，但它作为一种便利的审判形式被迅速推广到财税法庭〔court of exchequer〕的民事诉讼以及一些刑事诉讼当中，因此它成为现代巡回审判制度的前身。但巡回法院系统已于1971年被刑事法院〔Crown Court〕取代。 (2)〈美〉民事一审(初审)法院 民事一审法院的通称，通指采用陪审团审理方式，区别于上诉法院的一审事实审法院。可与「trial court」替换使用。但一般是用来特指以前设立于费城〔Philadelphia〕的民事初审法院，由宾夕法尼亚〔Pennsylvania〕州最高法院的一名法官主持，该法院已被宾州1874年宪法废止。 (=nisi prius court) (→nisi prius; assize; court of assize and nisi prius;
